BSLN PTY LTD - Terms and Conditions

IMPORTANT NOTICE: PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS.
Welcome to the BSLN_ community. These Terms and Conditions ("Terms") govern your use of and access to the BSLN_ website, mobile applications, content, products, and services (collectively, the "Platform"), which is owned and operated by BSLN PTY LTD (ACN 692507556), an Australian company based in New South Wales ("BSLN_", "we", "us", or "our").
By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.
1. User Accounts
1.1. Eligibility: To use the Platform, you must be at least 18 years of age and have the legal capacity to enter into a binding contract. You confirm that you are not under 16 years old.
1.2. Account Creation: You must provide accurate and complete information when creating your user account ("Account"). You are responsible for all activity that occurs under your Account.
1.3. Security: You are responsible for maintaining the confidentiality of your Account password. You must notify us immediately at contact@bsln.studio of any unauthorized use of your Account.
1.4. Suspension and Termination: We reserve the right to suspend or terminate your Account at any time for any reason, including for breach of these Terms, subject to applicable laws.
2. The BSLN_ Service
2.1. Founding Member Purchase: BSLN_ offers the PEAK SERIES program as a one-time purchase for lifetime access ("Founding Member Purchase"). The price is as stated on our website and is a one-time fee.
2.2. Future Subscription Model: We may introduce a subscription-based service in the future ("Subscription"). Founding Members will be eligible for a discount on this Subscription, the terms of which will be communicated at that time.
2.3. Payment: All payments are processed through our third-party payment processors (e.g., Stripe, PayPal) via the LearnWorlds platform. By providing your payment details, you represent that you are authorized to use those details.
2.4. No Refunds: Due to the digital nature of our content and the lifetime access granted upon purchase, all sales are final. We do not offer refunds for the Founding Member Purchase except as required by Australian Consumer Law or other applicable laws.
3. Use of the Platform
3.1. Lawful Use: You agree to use the Platform only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Platform.
3.2. Prohibited Conduct: You must not:
Engage in any unlawful activity.
Interfere with the Platform’s operation.
Defame, harass, or abuse others.
Provide false or misleading information.
Share your Account with any other person.
4. Health and Medical Disclaimer
4.1. Not Medical Advice: The content on the Platform is for informational purposes only and is not intended as medical advice, diagnosis, or treatment. The BSLN_ program is a fitness program.
4.2. Consult Your Doctor: You should consult with your healthcare professional before beginning this or any other fitness program to determine if it is right for your needs. This is particularly true if you have a history of health problems (including but not limited to heart disease, high blood pressure, or musculoskeletal issues).
4.3. Assumption of Risk: You acknowledge that any fitness activity carries inherent risks. You voluntarily assume all known and unknown risks associated with your use of the Platform.
5. Intellectual Property
5.1. Our Content: All content on the Platform, including text, graphics, logos, and videos, is the property of BSLN PTY LTD and is protected by copyright and other intellectual property laws.
5.2. Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your own personal, non-commercial use.
6. Third-Party Platforms (LearnWorlds)
Our Platform is hosted on LearnWorlds. Your use of the Platform is also subject to the Terms of Service of LearnWorlds. We are not responsible for the practices of LearnWorlds, and you should review their additional
terms and conditions and
privacy policy.
7. Limitation of Liability and Indemnity
7.1. Limitation of Liability: To the maximum extent permitted by law, BSLN PTY LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the Platform.
7.2. Indemnity: You agree to indemnify and hold harmless BSLN PTY LTD from any claims, damages, liabilities, costs, or expenses (including legal fees) arising out of your use of the Platform or your breach of these Terms.
8. European Union (EU) Users - GDPR
If you are a resident of the European Union, you have certain rights and protections under the General Data Protection Regulation (GDPR). Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your personal data.
8.1. Data Controller: BSLN PTY LTD is the data controller for the personal data we collect.
8.2. Lawful Basis for Processing: We process your data based on your consent, to fulfill our contractual obligations to you, and for our legitimate business interests.

9.1. Governing Law: These Terms are governed by the laws of New South Wales, Australia.
9.2. Dispute Resolution: Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.

We may revise these Terms from time to time. The most current version will always be on our website. By continuing to use the Platform after changes become effective, you agree to be bound by the revised Terms.
